Your Rights as a Consumer
Ontario’s Consumer Protection Act, 2002 (CPA) provides broad protections for consumers who purchase goods or services from businesses. The Act prohibits unfair practices: including false, misleading, or deceptive representations and unconscionable representations, and provides powerful remedies including rescission (cancellation) of the agreement and damages.

UNFAIR PRACTICES
False Representations & Unconscionable Conduct
Part III of the CPA sets out a comprehensive list of unfair practices. A false, misleading, or deceptive representation includes misrepresenting the quality, grade, or standard of goods; claiming sponsorship or approval that does not exist; using exaggeration or ambiguity that is likely to mislead; and representing that a transaction involves rights that it does not involve.
An unconscionable representation occurs when the business knows or ought to know that the consumer is unable to protect their own interests, that the price grossly exceeds the price of similar goods or services, or that the transaction is excessively one-sided. In Rushak v. Henneken, the court confirmed that unconscionability is assessed objectively, considering the totality of the circumstances.
CONSUMER REMEDIES
Rescission, Damages & Statutory Rights
A consumer who has entered into an agreement as a result of an unfair practice may rescind the agreement within one year after entering into it. Rescission restores the parties to their pre-contractual position: the consumer returns the goods (if applicable) and the business refunds all amounts paid. Under section 18(1) of the CPA, a consumer who has been subjected to an unfair practice has a right of action for damages, including exemplary (punitive) damages in appropriate cases.
The CPA also provides specific protections for internet agreements (Part III.1), direct agreements (door-to-door sales), future performance agreements, personal development services, and time-share agreements. Each category has its own disclosure requirements and cooling-off periods. We identify every applicable provision and pursue all available remedies.

What is an unfair practice under the Consumer Protection Act?
An unfair practice includes any false, misleading, or deceptive representation, or any unconscionable representation, made by a business in connection with a consumer transaction. The CPA contains a detailed list of specific unfair practices in sections 14 and 15.
Can I cancel a contract under the Consumer Protection Act?
Yes. The CPA provides several rescission (cancellation) rights. If you entered the agreement as a result of an unfair practice, you have up to one year to rescind. Other cancellation windows apply to specific agreement types, such as 10 days for direct agreements and internet agreements where disclosure requirements were not met.
What is the cooling-off period for door-to-door sales?
Under the CPA, consumers have 10 days to cancel a direct agreement (commonly known as a door-to-door sale) without any reason. If the business did not provide the required written copy of the agreement, the cancellation period extends to one year.
Can I sue a business for false advertising?
Yes. If a business made false, misleading, or deceptive representations that induced you to enter into a consumer agreement, you have a right of action under section 18 of the CPA. You may seek rescission of the agreement, a refund, and damages.
Does the CPA apply to all purchases?
The CPA applies to consumer transactions where an individual purchases goods or services for personal, family, or household purposes from a business. It does not apply to business-to-business transactions, real estate transactions, or transactions governed by other specific legislation such as insurance or securities.
What damages can I recover under the CPA?
You may recover actual damages suffered as a result of the unfair practice, plus exemplary (punitive) damages where the business’s conduct warrants it. You may also recover the costs of the action, including legal fees, under the CPA’s costs provisions.
Can I file a complaint with a government agency instead of suing?
Yes. You can file a complaint with the Ministry of Public and Business Service Delivery and Procurement (formerly the Ministry of Government and Consumer Services). However, a government complaint does not result in compensation, only a private action or Small Claims Court claim can recover your financial loss.

How we use it
Purpose
What you send is used to reply to you, to run a conflict check, to assess whether the firm can
assist, and, if a retainer follows, to carry out the work.
Marketing
We do not use your personal information for marketing without your express consent, and we

Privilege
Information given to us in the course of a legal matter is protected by solicitor client

Processing outside Canada

Your rights, and how long we keep things
Your rights under PIPEDA
Under the Personal Information Protection and Electronic Documents Act,
S.C. 2000, c. 5 you may ask what personal information we hold about you, ask us to correct
anything inaccurate, and withdraw consent to our use of it, subject to legal and contractual
limits. We reply within thirty days or explain why we need longer.
Retention
Client files are kept for the period the law and the Law Society require, ordinarily
seven years after a matter closes, which reflects limitation periods and the
possibility of later proceedings. After that they are securely destroyed or anonymised. You may
ask for earlier deletion, subject to those obligations.
Enquiries that do not become files
If you contact us and no retainer follows, what you sent is retained only as long as our conflict
records require, then destroyed.
If you are not satisfied with our answer you may complain to the Office of the Privacy
Commissioner of Canada.

What this site is
Information, not advice
This site publishes several hundred pages about Ontario law. They are written carefully, they cite
statutes and cases by name, and they are reviewed. None of that makes them advice about your
matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is
usually indefinite after a twenty year marriage is accurate as a general statement and may be
wrong about you, because of a domestic contract you signed, a period of separation you have
forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may
not reflect an amendment made since, and a page about a subject currently before an appellate
court may be overtaken between your reading it and your acting on it.
When we become your lawyers
Three things must happen first
A conflict check must be completed. We act for a great many people and
businesses, and we cannot act against a current client or use what we learned from a former one.
That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we
can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are
not doing, who is responsible for what, and how fees work. Until it is signed no relationship
exists, whatever has been discussed.
Confidentiality before a retainer
Why you should not send us documents yet
Information sent through a form, or by email, before a retainer is signed is not covered by
solicitor client privilege. That is not a policy we chose. It follows from there being no
solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we
are later approached by the other side, what you sent may affect whether we can act for either of
you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it
arose, and whether anything is urgent. That is enough for us to say whether we can help. The
documents come after the retainer.
Results, testimonials and reviews
What they do and do not tell you
Case results described anywhere on this site are real and are described accurately, and they are
specific to their own facts. A settlement at three times the original offer happened because of
that employer, that contract and that person’s history. It says nothing about what your
matter is worth.
Client reviews are the views of the people who wrote them. We do not offer anything in return for
a review, we do not write them, and we do not ask only the clients we expect to be positive.
Calculators on this site produce estimates from the figures you enter. They apply published
formulas and they cannot know about the facts that most often change the answer.
