To obtain a divorce in Ontario, you need three things: a legal marriage, at least one spouse who has been ordinarily resident in Ontario for at least one year, and grounds for divorce. For most Brampton couples, the grounds are the breakdown of the marriage established by one year of separation. The one year does not need to be continuous, if you separated, reconciled, and separated again, the periods can be added together.

Do I have to go to court for an uncontested divorce in Brampton?
No. For most uncontested divorces in Ontario, neither party is required to appear in court. The divorce is granted on paper by a Superior Court judge reviewing the application without a hearing. You receive the divorce certificate by mail.
Can I get divorced in Brampton if we were married in Punjab or another Indian state?
Yes. If you have been ordinarily resident in Ontario for at least one year, you can apply for a divorce in Ontario regardless of where you were married. The Ontario divorce order is recognized in most countries. To have it formally recognized in India, you may need to take additional registration steps, our Brampton divorce lawyers can advise on this.
What if my spouse does not agree to a divorce?
In Ontario, you do not need your spouse's consent to get a divorce. If they are uncooperative, you file a sole divorce application. Your spouse is served with the documents and has 30 days to respond. If they do not respond, the divorce proceeds on a default basis. The only absolute requirement is the one-year separation period.
How much does an uncontested divorce cost in Brampton?

Does my divorce automatically resolve child support and custody?
Not automatically. You must separately address support and parenting in either a court order or a separation agreement. Most Brampton clients resolve these issues through a separation agreement before or at the same time as the divorce.
My spouse has moved to another province or country. Can I still get divorced in Brampton?
Yes. If you have been ordinarily resident in Ontario for at least one year, you can file for divorce in Ontario regardless of where your spouse currently lives. Your spouse must be served with the divorce application, which can be done by mail, email (with a court order), or through a process server in the country where they reside.
How long has the one-year separation period been running?
The one-year period begins the day you and your spouse separated with the intention of living separate lives. You can be separated and living under the same roof, courts look at whether you functioned as a couple (shared a bed, ate meals together, presented as a couple to friends and family). If in doubt, document the date of separation clearly and keep it consistent in all legal documents.
