How long does an uncontested divorce take in Mississauga?
An uncontested divorce in Peel Superior Court typically takes 90 to 120 days from the date of filing. This assumes the application is complete and accurate when filed. Delays in service of documents on the respondent spouse can extend this timeline.
What is the difference between a joint divorce and an uncontested divorce?
A joint divorce application is filed by both spouses together. It requires both to sign the application. An uncontested divorce is filed by one spouse (the petitioner) and the other spouse (the respondent) simply does not contest it. Both result in the same outcome, a divorce order and divorce certificate.
Do I have to go to court for an uncontested divorce in Mississauga?
No. For most uncontested divorces in Ontario, neither party is required to appear in court. The divorce is granted on paper by a Superior Court judge reviewing the application without a hearing. You will receive the divorce order by mail.
Can I get divorced if I cannot locate my spouse?
Yes, but the process is more complex. If you cannot locate your spouse to serve them with the divorce application, you can bring a motion for substituted service (service by an alternative method) or for dispensing with service altogether in appropriate cases. This requires a court motion and supporting evidence.
What happens to our Mississauga property when we divorce?
Property division. The equalization of net family property, is separate from the divorce itself. You can obtain a divorce and resolve property division in the same proceeding, or separately. The divorce order deals with the dissolution of the marriage; the property division is addressed either in a separation agreement or in a court order for equalization.
