TRUSTEE REMOVAL
Removing an Estate Trustee in Ontario
Under s. 37 of the Trustee Act, the Ontario Superior Court of Justice has the authority to remove an estate trustee and to appoint a replacement where it is just and convenient to do so. The court exercises this power where the trustee has been guilty of misconduct, has become incapable of acting, has absconded, or where there is a conflict of interest that renders the trustee unsuitable to continue in their role.
The leading Ontario authority on trustee removal is Letterstedt v. Broers (1884), as adopted and applied by Canadian courts. The guiding principle is the welfare of the beneficiaries and the proper administration of the estate. The court will consider whether the trustee's conduct has endangered the trust property, whether there has been a breakdown in the relationship between the trustee and the beneficiaries, and whether removal is in the overall best interests of the estate.
GROUNDS
Common Grounds for Trustee Removal
The most frequently cited grounds for removal include breach of fiduciary duty, self-dealing, failure to administer the estate with reasonable diligence, failure to keep proper accounts, partiality among beneficiaries, and unreasonable delay in distributing the estate. An estate trustee who uses estate funds for personal purposes, who fails to invest estate assets prudently under the Trustee Act, or who refuses to provide beneficiaries with information about the estate's administration, may face removal.
Hostility between the trustee and the beneficiaries alone is generally insufficient to warrant removal, unless the hostility is so severe that it impedes the administration of the estate. Similarly, mere dissatisfaction with an estate trustee's management decisions does not justify removal. The applicant must demonstrate actual misconduct or a real risk to the estate's assets or administration.
PROCEDURE
The Application Process and Replacement Trustees
An application for the removal of an estate trustee is brought under Rule 75.06 of the Rules of Civil Procedure. The applicant must serve the application on all beneficiaries and interested parties. Where the matter is urgent, the applicant may also seek interim relief, including an order restraining the estate trustee from dealing with estate assets pending the hearing.
When the court removes an estate trustee, it will typically appoint a replacement. The replacement trustee may be a beneficiary, a family member, or a professional trust company. Under s. 5 of the Trustee Act, the court has broad discretion in selecting a replacement and will consider the size and complexity of the estate, the wishes of the beneficiaries, and the suitability of the proposed replacement. The outgoing trustee must provide a full accounting and transfer all estate assets to the replacement trustee.

What constitutes a breach of fiduciary duty by an estate trustee?
A breach of fiduciary duty includes self-dealing, using estate assets for personal benefit, failing to keep proper accounts, failing to invest prudently, showing partiality among beneficiaries, unreasonable delay in administration, and failing to provide information to beneficiaries about the estate.
Who can apply to remove an estate trustee?
Any beneficiary, co-trustee, creditor, or other person with a legitimate interest in the estate may apply to the court for the removal of an estate trustee. The Public Guardian and Trustee may also bring or participate in removal applications.
Can an estate trustee be required to compensate beneficiaries?
Yes. An estate trustee who has caused losses to the estate through breach of fiduciary duty may be ordered to compensate the estate. The court may also reduce or eliminate the trustee's compensation and may order the trustee to pay the legal costs of the removal application personally.
What happens after an estate trustee is removed?
The court will appoint a replacement estate trustee under s. 5 of the Trustee Act. The removed trustee must provide a full accounting of their administration and transfer all estate assets and records to the replacement trustee.
Can hostility between the trustee and beneficiaries justify removal?
Hostility alone is generally insufficient. However, where the friction is so severe that it impedes the proper administration of the estate and jeopardizes the interests of the beneficiaries, it may be a relevant factor supporting removal.
How long does a trustee removal application take?
The timeline depends on the complexity of the matter and the court's schedule. Simple applications may be heard within 30 to 60 days, while contested matters requiring cross-examinations or expert evidence may take several months. Urgent cases may be expedited through a motion for interim relief.

Your rights, and how long we keep things
Your rights under PIPEDA
Under the Personal Information Protection and Electronic Documents Act,
S.C. 2000, c. 5 you may ask what personal information we hold about you, ask us to correct
anything inaccurate, and withdraw consent to our use of it, subject to legal and contractual
limits. We reply within thirty days or explain why we need longer.
Retention
Client files are kept for the period the law and the Law Society require, ordinarily
seven years after a matter closes, which reflects limitation periods and the
possibility of later proceedings. After that they are securely destroyed or anonymised. You may
ask for earlier deletion, subject to those obligations.
Enquiries that do not become files
If you contact us and no retainer follows, what you sent is retained only as long as our conflict
records require, then destroyed.
If you are not satisfied with our answer you may complain to the Office of the Privacy
Commissioner of Canada.

What this site is
Information, not advice
This site publishes several hundred pages about Ontario law. They are written carefully, they cite
statutes and cases by name, and they are reviewed. None of that makes them advice about your
matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is
usually indefinite after a twenty year marriage is accurate as a general statement and may be
wrong about you, because of a domestic contract you signed, a period of separation you have
forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may
not reflect an amendment made since, and a page about a subject currently before an appellate
court may be overtaken between your reading it and your acting on it.
When we become your lawyers
Three things must happen first
A conflict check must be completed. We act for a great many people and
businesses, and we cannot act against a current client or use what we learned from a former one.
That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we
can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are
not doing, who is responsible for what, and how fees work. Until it is signed no relationship
exists, whatever has been discussed.
Confidentiality before a retainer
Why you should not send us documents yet
Information sent through a form, or by email, before a retainer is signed is not covered by
solicitor client privilege. That is not a policy we chose. It follows from there being no
solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we
are later approached by the other side, what you sent may affect whether we can act for either of
you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it
arose, and whether anything is urgent. That is enough for us to say whether we can help. The
documents come after the retainer.
Results, testimonials and reviews
What they do and do not tell you
Case results described anywhere on this site are real and are described accurately, and they are
specific to their own facts. A settlement at three times the original offer happened because of
that employer, that contract and that person’s history. It says nothing about what your
matter is worth.
Client reviews are the views of the people who wrote them. We do not offer anything in return for
a review, we do not write them, and we do not ask only the clients we expect to be positive.
Calculators on this site produce estimates from the figures you enter. They apply published
formulas and they cannot know about the facts that most often change the answer.
