Yes. If you have been ordinarily resident in Ontario for at least one year, you can file for divorce in Ontario regardless of where your marriage was registered. The resulting Ontario divorce order is recognized in most countries, though you may need additional steps to have it formally recognized in India. This is a potential international child abduction matter and you should contact a lawyer immediately. India is not a signatory to the Hague Convention on international child abduction, which makes recovery more difficult but not impossible.
