A conviction from a country with functioning courts is harder to displace. Harder is not the same as impossible, and the law does not permit it to be assumed away.
The Short Answer
Can a refugee claim be excluded because of a conviction in another country?
It can, but not automatically. A decision maker may in a proper context rely on a foreign indictment or warrant to find serious reasons for considering that a crime was committed. That reliance rests on a premise: that in a system where the rule of law prevails, there were reasonable and probable grounds for the charge. Before applying the premise, the decision maker must be satisfied that the issuing authority itself respects the rule of law, and must conduct a proper and objective assessment of all the evidence the claimant puts forward.

THE PREMISE
What Arevalo Pineda Actually Says
Arevalo Pineda v Canada, 2010 FC 454 is the case most often cited for the proposition that a foreign charge can support an exclusion finding. Paragraphs 28 and 29 record that the tribunal can, in a proper context, rely on an indictment and warrant, on the premise that in a rule of law system there were reasonable and probable grounds for issuing them.
The passages around those two are the ones that decide most cases, and they are cited far less often. Paragraph 27 requires a proper and objective assessment of the context and of all the evidence presented by the claimant. Paragraph 30 says the premise applies only where the decision maker is first satisfied that the issuing authority respects the rule of law, and is not dealing with a country known for filing false charges as harassment or intimidation. Paragraph 38 says that where the claimant denies involvement, credibility and the weight of that denial must be addressed.
Relying on paragraphs 28 and 29 while omitting 27, 30 and 38 is reliance on authority stripped of its qualifying context. In Mîra v Canada, 2026 FC 603, the Federal Court held that this does not meet the standard of justification a reasonable decision requires.
FABRICATION
When You Say the Charges Were False
This changes what the decision maker has to do. Normally a tribunal does not inquire into guilt or innocence, and a valid foreign warrant will satisfy the serious reasons standard. But where the claimant alleges the charges are fabricated, the tribunal has to go further and decide whether to accept that allegation. If the claimant is found credible, the mere existence of a warrant may not be enough: Qazi v Canada, 2005 FC 1204 at paragraphs 18 and 19.
That principle has been applied repeatedly: Vlad v Canada, 2007 FC 172 at paragraph 25; Gurajena v Canada, 2008 FC 724; Jain v Canada, 2023 FC 539 at paragraph 27; and more recently Horvathne Majoros v Canada, 2025 FC 843, where no assessment of the issuing authority had been carried out at all.
The practical consequence is that a credibility finding in your favour at first instance is valuable on appeal, and should be identified and relied on rather than left in the record.
DEMOCRATIC STATES
Convictions From Rule of Law Countries
This is the difficult version of the argument. Where the conviction comes from a European Union member state, or another country with a functioning and independent judiciary, the presumption behind the premise is at its strongest, and a decision maker will often treat the conviction as settling the question.
The law does not permit that shortcut. The assessment required by paragraph 30 of Arevalo Pineda is of the issuing authority, not of the country in general. A state can have a functioning court system and a prosecuting body with documented integrity problems at the same time, and evidence going to the latter is not answered by observations about the former.
Timing matters too. Country evidence describing improvements years after the events in question does not address conditions at the time the charge was laid: Hernandez Hernandez v Canada, 2010 FC 1323 at paragraphs 47 and 48.
We argued exactly this in Mîra. The conviction was Romanian, the Division reasoned from Romania being a country where the rule of law prevails, and the Federal Court found the analysis unreasonable because no assessment of the prosecuting authority had been undertaken and the claimant's own evidence had not been engaged with.
BUILDING IT
What the Argument Requires
Displacing this kind of finding is evidentiary work rather than advocacy:
Evidence about the prosecuting body, not the country. Reporting, official findings, prosecutions of its own officials.
A link to your file. Named prosecutors, named officials, the same period, the same institution.
Contemporaneous material. Conditions when the charge was laid, not when the appeal is heard.
Your own account, tested. The nature of the report or act, why the demand was made, what happened when it was refused.
The first instance findings. A credibility finding in your favour has to be put front and centre.

No. A conviction is evidence and a decision maker may rely on it in a proper context, but only after assessing your evidence and satisfying itself that the issuing authority respects the rule of law.
The conviction is from an EU country. Is the argument hopeless?
It is harder, not hopeless. The assessment required is of the authority that issued the charge, not of the country generally. A state can have functioning courts and a prosecuting body with documented problems at the same time.
I was convicted in my absence. Does that matter?
It can. The circumstances of the trial, including whether you were present or represented, form part of the context a decision maker is required to assess.
What if the tribunal found me credible?
That is significant. Qazi holds that where you allege fabrication and are found credible, the existence of a warrant alone may not be enough, and the decision maker must go further.
What evidence helps most?
Material about the specific prosecuting authority and the individuals connected to your case, from the period when the charge was laid. General country reports about later improvements are the weakest kind.
Has this argument succeeded?
Yes. In Mîra v Canada, 2026 FC 603, the Federal Court set aside an exclusion finding based on a Romanian conviction, holding the analysis unreasonable. Every case turns on its own facts and record.

Your rights, and how long we keep things
Your rights under PIPEDA
Under the Personal Information Protection and Electronic Documents Act,
S.C. 2000, c. 5 you may ask what personal information we hold about you, ask us to correct
anything inaccurate, and withdraw consent to our use of it, subject to legal and contractual
limits. We reply within thirty days or explain why we need longer.
Retention
Client files are kept for the period the law and the Law Society require, ordinarily
seven years after a matter closes, which reflects limitation periods and the
possibility of later proceedings. After that they are securely destroyed or anonymised. You may
ask for earlier deletion, subject to those obligations.
Enquiries that do not become files
If you contact us and no retainer follows, what you sent is retained only as long as our conflict
records require, then destroyed.
If you are not satisfied with our answer you may complain to the Office of the Privacy
Commissioner of Canada.

What this site is
Information, not advice
This site publishes several hundred pages about Ontario law. They are written carefully, they cite
statutes and cases by name, and they are reviewed. None of that makes them advice about your
matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is
usually indefinite after a twenty year marriage is accurate as a general statement and may be
wrong about you, because of a domestic contract you signed, a period of separation you have
forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may
not reflect an amendment made since, and a page about a subject currently before an appellate
court may be overtaken between your reading it and your acting on it.
When we become your lawyers
Three things must happen first
A conflict check must be completed. We act for a great many people and
businesses, and we cannot act against a current client or use what we learned from a former one.
That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we
can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are
not doing, who is responsible for what, and how fees work. Until it is signed no relationship
exists, whatever has been discussed.
Confidentiality before a retainer
Why you should not send us documents yet
Information sent through a form, or by email, before a retainer is signed is not covered by
solicitor client privilege. That is not a policy we chose. It follows from there being no
solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we
are later approached by the other side, what you sent may affect whether we can act for either of
you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it
arose, and whether anything is urgent. That is enough for us to say whether we can help. The
documents come after the retainer.
Results, testimonials and reviews
What they do and do not tell you
Case results described anywhere on this site are real and are described accurately, and they are
specific to their own facts. A settlement at three times the original offer happened because of
that employer, that contract and that person’s history. It says nothing about what your
matter is worth.
Client reviews are the views of the people who wrote them. We do not offer anything in return for
a review, we do not write them, and we do not ask only the clients we expect to be positive.
Calculators on this site produce estimates from the figures you enter. They apply published
formulas and they cannot know about the facts that most often change the answer.
