PROGRAM OVERVIEW
The Global Talent Stream
The Global Talent Stream (GTS) is a dedicated service channel within the Temporary Foreign Worker Program (TFWP) that provides expedited Labour Market Impact Assessment (LMIA) processing for Canadian employers seeking to hire highly skilled foreign workers in specific occupations. Launched in June 2017 as a component of Canada’s Global Skills Strategy, the GTS targets a processing standard of 14 business days for LMIA applications, compared to the standard processing time of several months for regular LMIA applications under section 200(1) of the IRPR.
The GTS operates through two categories. Category A is designed for employers who have been referred to the GTS by one of ESDC’s designated referral partners, organizations such as the National Research Council’s Industrial Research Assistance Program (NRC-IRAP), Innovation Solutions Canada, or designated provincial or territorial partners. Category B applies to employers seeking to hire foreign workers in occupations on ESDC’s Global Talent Occupations List, which identifies occupations experiencing persistent labour shortages across Canada, primarily in the technology, engineering, and life sciences sectors.
CATEGORY A & B
GTS Category Requirements & Eligibility
Category A requires a referral from a designated referral partner confirming that the employer is seeking to hire unique and specialized talent that is not readily available in Canada. The referral partner assesses whether the foreign worker possesses specialized skills, knowledge, or experience that will benefit the Canadian innovation ecosystem. Category A is not limited to specific occupations; the referral partner evaluates the position on a case-by-case basis.
Category B is occupation-specific. ESDC publishes and periodically updates the Global Talent Occupations List, which currently includes occupations such as computer and information systems managers (NOC 20012), software engineers and designers (NOC 21231), computer programmers and interactive media developers (NOC 21230), database analysts and data administrators (NOC 21223), and digital media designers (NOC 21211), among others. Employers hiring for a Category B occupation must demonstrate that the position meets or exceeds the prevailing wage for the occupation and region, and that the foreign worker has the required qualifications.

The LMBP Obligation
A distinctive feature of the Global Talent Stream is the Labour Market Benefits Plan (LMBP), which replaces the standard transition plan required under regular LMIA applications. The LMBP requires the employer to commit to activities that will create lasting, positive benefits for the Canadian labour market. These commitments are negotiated with ESDC and may include job creation for Canadians and permanent residents, investment in skills training and development for Canadian employees, investment in proprietary knowledge transfer, support for post-secondary co-op placements, and contributions to industry-specific skills development initiatives.

The LMBP is negotiated with ESDC and is subject to compliance monitoring.
Which occupations are on the Global Talent Occupations List?
The Global Talent Occupations List is published and periodically updated by ESDC. It typically includes technology and STEM occupations such as computer and information systems managers, software engineers and designers, computer programmers, database analysts, information systems analysts, web designers, and certain engineering and life sciences positions. Employers should consult the current list on the ESDC website or confirm eligibility with legal counsel, as the list is subject to change.
Does the employer need to recruit Canadians before applying under the GTS?
GTS applications are exempt from the standard recruitment advertising requirements that apply to regular LMIA applications. Employers do not need to demonstrate that they advertised the position and were unable to find a qualified Canadian worker. However, employers must still offer wages that meet or exceed the prevailing wage for the occupation and region, and they must commit to Labour Market Benefits Plan obligations that benefit Canadian workers.
Can a GTS work permit lead to permanent residence?
Yes. While the GTS itself is a temporary work permit program, the Canadian work experience gained under a GTS work permit may qualify the foreign worker for permanent residence through programs such as the Canadian Experience Class (CEC) under Express Entry, provided the worker accumulates at least one year of qualifying Canadian work experience in a NOC TEER 0 or 1 occupation. Provincial nominee programs may also nominate workers with GTS work permits.
What are the employer compliance obligations under the GTS?
GTS employers are subject to the employer compliance framework under sections 209.2 through 209.4 of the IRPR. This includes compliance with the terms and conditions of the LMIA, fulfillment of LMBP commitments, adherence to employment standards legislation, and cooperation with ESDC inspections. Non-compliance may result in warning letters, administrative monetary penalties of up to $100,000 per violation, temporary or permanent bans from the TFWP, and publication of the employer’s name on IRCC’s list of non-compliant employers.

Your rights under PIPEDA
Under the Personal Information Protection and Electronic Documents Act,
S.C. 2000, c. 5 you may ask what personal information we hold about you, ask us to correct

limits. We reply within thirty days or explain why we need longer.
Retention
Client files are kept for the period the law and the Law Society require, ordinarily
seven years after a matter closes, which reflects limitation periods and the
possibility of later proceedings. After that they are securely destroyed or anonymised. You may
ask for earlier deletion, subject to those obligations.
Enquiries that do not become files
If you contact us and no retainer follows, what you sent is retained only as long as our conflict
records require, then destroyed.
If you are not satisfied with our answer you may complain to the Office of the Privacy

What this site is
Information, not advice
This site publishes several hundred pages about Ontario law. They are written carefully, they cite
statutes and cases by name, and they are reviewed. None of that makes them advice about your
matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is
usually indefinite after a twenty year marriage is accurate as a general statement and may be
wrong about you, because of a domestic contract you signed, a period of separation you have
forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may
not reflect an amendment made since, and a page about a subject currently before an appellate
court may be overtaken between your reading it and your acting on it.
When we become your lawyers
Three things must happen first
A conflict check must be completed. We act for a great many people and
businesses, and we cannot act against a current client or use what we learned from a former one.
That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we
can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are
not doing, who is responsible for what, and how fees work. Until it is signed no relationship
exists, whatever has been discussed.
Confidentiality before a retainer
Why you should not send us documents yet
Information sent through a form, or by email, before a retainer is signed is not covered by
solicitor client privilege. That is not a policy we chose. It follows from there being no
solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we
are later approached by the other side, what you sent may affect whether we can act for either of
you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it
arose, and whether anything is urgent. That is enough for us to say whether we can help. The
documents come after the retainer.
Results, testimonials and reviews
What they do and do not tell you
Case results described anywhere on this site are real and are described accurately, and they are
specific to their own facts. A settlement at three times the original offer happened because of
that employer, that contract and that person’s history. It says nothing about what your
matter is worth.
