7. Corollary Relief, Property, Custody, and Support

Property Division (NFP Equalization)

Ontario uses equalization of net family property. Each spouse calculates their NFP. The higher-NFP spouse pays half the difference. The matrimonial home cannot be excluded even if owned before marriage.

Child Custody & Parenting Time

Under 2021 Divorce Act amendments, courts apply the best interests of the child. No presumption favours either parent. Decision-making responsibility replaces the term custody.

Child Support

Calculated using Federal Child Support Guidelines based on the paying parent's gross income. Cannot be waived. Section 7 expenses shared proportionally on top.

Spousal Support

Not automatic. Requires entitlement based on economic disadvantage or need. The Spousal Support Advisory Guidelines (SSAGs) provide advisory ranges for amount and duration.

How long do you have to be separated before divorce in Ontario?
At least one year under s.8(2)(a) of the Divorce Act. You can file before the year is up. The year just keeps running until the order is granted.
Can I be separated while living in the same house?
Yes. Courts recognize separation under one roof where both parties treat the relationship as over, separate finances, no shared marital activities.
Do both spouses need a lawyer?
Not legally required, but strongly advised. For contested divorces, self-representation against a represented spouse is extremely difficult and almost always produces worse outcomes.
How much does a divorce cost in Ontario in 2025?
Mandatory court fees total $679. An uncontested divorce typically costs $2,000-$5,000 total with a lawyer. A fully contested divorce can cost $20,000-$100,000+ per side.
Where do I file for divorce in Ontario?
Since October 14, 2025, through the Ontario Courts Public Portal (OCPP). Your lawyer files on your behalf. The application is assigned to Superior Court in the region where you or your spouse lives.
