The Hague Convention on the Civil Aspects of International Child Abduction (1980) is an international treaty designed to secure the prompt return of children who have been wrongfully removed to or retained in a Contracting State. In Ontario, it is implemented through the Children’s Law Reform Act, R.S.O. 1990, c. C.12, Part III.

The Hague Convention on the Civil Aspects of International Child Abduction (1980) is the primary international treaty governing the wrongful removal or retention of children across international borders. In Ontario, the Convention is implemented through the Children’s Law Reform Act, R.S.O. 1990, c. C.12, Part III, sections 40 through 57. The Convention’s central objective is the prompt return of the child to the State of habitual residence, so that the courts of that jurisdiction can make custody determinations. It is emphatically not a custody adjudication mechanism, rather, it is a procedural remedy designed to restore the status quo ante.
To succeed in a Hague Convention application, the left-behind parent must establish that the child was habitually resident in a Contracting State immediately before the wrongful removal or retention, that the removal or retention breached custody rights under the law of that State, and that those custody rights were actually being exercised at the time. The concept of habitual residence, as interpreted by the Supreme Court of Canada in Office of the Children’s Lawyer v. Balev, 2018 SCC 16, requires a fact-driven inquiry focusing on the circumstances of the child’s life rather than parental intention alone.
The Convention provides narrow defences to a return order. Under Article 13(b), the taking parent may resist return by establishing a grave risk that return would expose the child to physical or psychological harm or otherwise place the child in an intolerable situation. This defence is interpreted restrictively; the Supreme Court of Canada in Thomson v. Thomson, [1994] 3 SCR 551, emphasized that the grave risk exception should not become a vehicle for relitigating the underlying custody dispute. Courts assess whether protective measures in the requesting State could adequately address the identified risks.
Additional defences include Article 13(a), which applies where the left-behind parent was not actually exercising custody rights or consented to or subsequently acquiesced in the removal. Article 12 provides that if proceedings are commenced more than one year after the wrongful removal, the court may refuse to order return if the child is now settled in the new environment. The child’s own objections may also be considered under Article 13 where the child has attained an age and degree of maturity at which it is appropriate to take account of their views. Hague Convention proceedings are inherently urgent. Under CLRA s.46, the Ontario Superior Court of Justice has jurisdiction to hear return applications. The Convention contemplates that judicial authorities should act expeditiously, with Article 11 providing that a decision should be reached within six weeks from the date of commencement. In practice, Ontario courts recognize the urgency of these matters and schedule hearings on an accelerated basis. Enforcement of return orders requires careful coordination with the requesting State. Once the Ontario court orders return, the left-behind parent must arrange for the child’s physical return, which may involve securing travel documents, coordinating with law enforcement, and obtaining undertakings to protect the taking parent from criminal prosecution upon return. Where a non-Convention country is involved, the remedies are more limited and may require reliance on the CLRA Part III provisions on recognition of extra-provincial custody orders or diplomatic channels. This site publishes several hundred pages about Ontario law. They are written carefully, they cite statutes and cases by name, and they are reviewed. None of that makes them advice about your matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is usually indefinite after a twenty year marriage is accurate as a general statement and may be wrong about you, because of a domestic contract you signed, a period of separation you have forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may not reflect an amendment made since, and a page about a subject currently before an appellate court may be overtaken between your reading it and your acting on it.
A conflict check must be completed. We act for a great many people and businesses, and we cannot act against a current client or use what we learned from a former one. That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are not doing, who is responsible for what, and how fees work. Until it is signed no relationship exists, whatever has been discussed.
Information sent through a form, or by email, before a retainer is signed is not covered by solicitor client privilege. That is not a policy we chose. It follows from there being no solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we are later approached by the other side, what you sent may affect whether we can act for either of you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it arose, and whether anything is urgent. That is enough for us to say whether we can help. The documents come after the retainer.
Case results described anywhere on this site are real and are described accurately, and they are specific to their own facts. A settlement at three times the original offer happened because of that employer, that contract and that person’s history. It says nothing about what your matter is worth.
