- ESA entitlements are minimums. An agreement to accept less is not enforceable.
- It covers hours, overtime, public holidays, vacation, leaves, and termination.
- Not everyone is covered, and some occupations have their own rules or exemptions.
- The complaint route and the court route are alternatives for the same loss, not additions.
What it is
The Employment Standards Act sets the minimum terms for most non-unionised employment in Ontario. Its central feature is that it cannot be contracted out of: an agreement providing less than the Act requires has no effect to that extent.
It is a floor, not a description of what an employee is entitled to. Many employees have contractual or common law rights well above it.
What it covers
The main areas are:
- Wages. Minimum wage, timing of payment, and rules on deductions.
- Hours and overtime. Daily and weekly limits, required rest periods, and overtime pay after a weekly threshold.
- Public holidays. Which days qualify and how pay and substitute days work.
- Vacation. Minimum time and minimum vacation pay, which increase with length of service.
- Leaves. A substantial list, including sick leave, family responsibility, bereavement, pregnancy and parental leave, and several others.
- Termination and severance. Minimum notice, and severance pay where the qualifying conditions are met.
Leaves are generally job-protected and generally unpaid unless a specific provision says otherwise. Job-protected means the employee is entitled to return to their position or a comparable one.
Coverage and exemptions
Most employees in Ontario are covered, but not all, and the exemptions are a genuine trap.
Federally regulated sectors, banking, telecommunications, interprovincial transport, and others, fall under the Canada Labour Code instead, not the ESA.
Within provincial jurisdiction, certain occupations are exempt from particular parts. Some managerial and supervisory employees are exempt from hours and overtime provisions, as are certain professionals and some IT roles, among others.
Two points about the managerial exemption in particular. It is about the work actually performed, not the job title. And it exempts from specific parts, not from the whole Act, a manager exempt from overtime still has vacation, leave and termination entitlements.
Employee or contractor
The Act applies to employees. It does not apply to genuine independent contractors.
Whether someone is an employee is determined by the substance of the relationship, not by what the contract calls them or whether they invoice. Relevant considerations include control over how the work is done, ownership of tools, chance of profit and risk of loss, and integration into the business.
Misclassification is common and is expressly prohibited. A worker treated as a contractor who is in substance an employee retains the full range of statutory entitlements.
Enforcing it
An employee can file a complaint with the Ministry of Labour, which can investigate and order payment. It is free, and no lawyer is required.
There are deadlines, and they are shorter than the limitation period for a court claim. Delay can extinguish an ESA complaint that a court action would still permit.
The important structural point: an employee generally cannot both file a complaint and sue for the same loss. Filing forecloses the civil claim for that entitlement, and because common law notice is usually far larger than the statutory minimum, filing a complaint can be the wrong choice for someone with a substantial wrongful dismissal claim.
That is a decision worth taking advice on before filing, not after.
Reprisal
An employer cannot penalise an employee for asking about ESA rights, exercising them, or filing a complaint. Reprisal is prohibited and separately actionable.
Common questions
Can I agree to give up overtime pay?
Not simply by agreement. There are regulated averaging and time-off-in-lieu arrangements with their own requirements, but a plain waiver is not effective.
Is severance pay the same as termination pay?
No. They are separate entitlements with different qualifying conditions, and an employee may be entitled to both.
Do I get vacation pay on commissions?
Vacation pay is calculated on wages, which is broader than base salary. What is included depends on how the compensation is characterised.
What if my employer misclassified me as a contractor?
The substance of the relationship governs. A worker who was in fact an employee retains statutory entitlements regardless of the label used.
