Technically, a landlord can serve an N4 notice once any amount of rent is owing. However, under s. 74 of the RTA, you can void the eviction by paying the full amount of arrears plus the application filing fee before the LTB issues an eviction order.

Rent arrears proceedings begin when a landlord serves an N4 Notice to End a Tenancy Early for Non-payment of Rent under s. 59 of the Residential Tenancies Act, 2006. The N4 must provide the tenant with at least 14 days' notice and accurately state the amount of rent owing. If the tenant does not pay the full arrears within the notice period, the landlord may file an L1 Application to Evict a Tenant for Non-payment of Rent and to Collect Rent the Tenant Owes. The LTB will then schedule a hearing where both parties can present evidence and arguments.
An N4 notice must strictly comply with the requirements of s. 59 of the RTA. The notice must identify the correct rental periods, accurately calculate the amount owing, and provide the correct termination date. Errors in any of these elements can render the notice void, requiring the landlord to start the process over. Our lawyers examine every N4 notice for technical deficiencies and challenge defective notices before the LTB.
Tenants facing L1 applications have several important defences. Under s. 82 of the RTA, a tenant may raise at the hearing any issue that could be the subject of a tenant application, including the landlord's failure to maintain the rental unit in a good state of repair (s. 20), interference with reasonable enjoyment (s. 22), harassment (s. 23), and illegal entry (s. 25). If the LTB finds that the landlord has breached these obligations, it may order a rent abatement that offsets or eliminates the arrears claimed.
The principle of set-off is well established in LTB proceedings. In Onyskiw v. CJM Property Management Ltd., 2016 ONCA 477, the Ontario Court of Appeal confirmed that tenants are entitled to raise maintenance issues as a defence to rent arrears claims. We document maintenance deficiencies through photographs, inspection reports, municipal property standards orders, and tenant communications to establish the quantum of any rent abatement that should be applied against the arrears. This approach frequently results in a significant reduction of the landlord's claim or its complete elimination.
For tenants who owe arrears but wish to preserve their tenancy, the LTB can order a payment plan under s. 78 of the RTA. A payment plan requires the tenant to pay current rent plus an additional amount toward the arrears on a regular schedule. If the tenant defaults on the payment plan, the landlord may file an L4 application for an ex parte eviction order without a new hearing. Our lawyers negotiate reasonable payment plans that tenants can realistically maintain while protecting the tenant from immediate eviction.
For landlords, we ensure that L1 applications are properly prepared with accurate rent ledgers, properly served N4 notices, and clear evidence of the amounts owing. Where tenants raise s. 82 defences, we prepare responsive evidence addressing maintenance claims and challenging inflated abatement requests. We also advise landlords on the use of L9 applications to collect rent arrears after a tenant has moved out, and on the enforcement of LTB orders through the Small Claims Court or Superior Court where necessary.

This site publishes several hundred pages about Ontario law. They are written carefully, they cite statutes and cases by name, and they are reviewed. None of that makes them advice about your matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is usually indefinite after a twenty year marriage is accurate as a general statement and may be wrong about you, because of a domestic contract you signed, a period of separation you have forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may not reflect an amendment made since, and a page about a subject currently before an appellate court may be overtaken between your reading it and your acting on it.
A conflict check must be completed. We act for a great many people and businesses, and we cannot act against a current client or use what we learned from a former one. That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are not doing, who is responsible for what, and how fees work. Until it is signed no relationship exists, whatever has been discussed.
Information sent through a form, or by email, before a retainer is signed is not covered by solicitor client privilege. That is not a policy we chose. It follows from there being no solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we are later approached by the other side, what you sent may affect whether we can act for either of you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it arose, and whether anything is urgent. That is enough for us to say whether we can help. The documents come after the retainer.
Case results described anywhere on this site are real and are described accurately, and they are specific to their own facts. A settlement at three times the original offer happened because of that employer, that contract and that person’s history. It says nothing about what your matter is worth.
