A T3 asks the Board to lower the lawful rent, usually after a municipal tax decrease or because a service was reduced or discontinued. Not every change qualifies. We act for landlords in showing what was actually provided, what changed, and what it was worth.

The T3 Application for a Rent Reduction is a tenant's tool for seeking a decrease in rent at the Landlord and Tenant Board. Under s. 125 of the Residential Tenancies Act, 2006, a tenant or group of tenants may apply for a rent reduction based on a reduction in municipal taxes and charges for the residential complex. Under s. 128, tenants can seek a reduction when a previous above-guideline increase (AGI) for capital expenditures has reached the end of its useful life period and should be removed from the lawful rent calculation.
Additionally, tenants may seek a rent reduction where the landlord has substantially reduced or discontinued a service or facility that was provided at the time rent was set. Under s. 130 of the RTA, the LTB may order a reduction in rent if the landlord has reduced or discontinued services or facilities, including parking, laundry facilities, storage lockers, recreational amenities, or building staff services, without a corresponding reduction in rent. The reduction is proportional to the value of the discontinued service.
When municipal property taxes for a residential complex decrease, tenants are entitled to a corresponding rent reduction under s. 125 of the RTA. The calculation is prescribed by O. Reg. 516/06, ss. 36-40, and considers the property tax decrease as a percentage of the total tax bill and its proportional impact on the rent for each unit. The reduction must be applied by the landlord within the prescribed timeframe, and tenants who do not receive the automatic reduction can file a T3 application to compel it.
Municipal tax reassessments, shifts in tax class ratios, and changes in the education tax levy can all result in reduced property taxes. Our lawyers monitor municipal property assessment records and tax roll data to identify potential rent reduction entitlements for tenants. In multi-unit residential buildings, even a modest tax decrease can translate into meaningful rent reductions for each tenant when calculated across the entire complex. We coordinate with tenant associations to file collective T3 applications, which are more efficient and ensure that all eligible tenants benefit from the reduction.
Service reductions represent a frequently overlooked basis for rent decreases. Under s. 130 of the RTA, when a landlord discontinues or substantially reduces a service or facility that existed when the tenant moved in or when the current rent was established, the LTB may reduce the rent to reflect the decreased value. Examples include removing a superintendent, eliminating on-site laundry, discontinuing a shuttle service, closing recreational facilities, or reducing maintenance and cleaning services in common areas. The rent reduction is retroactive to the date the service was reduced.
Above-guideline increases for capital expenditures are temporary and must be removed from the lawful rent when the useful life of the improvement expires. Under s. 128 of the RTA, the AGI component should automatically be phased out based on the useful life schedule in O. Reg. 516/06. However, landlords frequently fail to reduce the rent when the AGI period ends. Tenants can file a T3 application to compel the reduction and recover overpayments. If you contact us and no retainer follows, what you sent is retained only as long as our conflict records require, then destroyed.

Short, and written to be read rather than scrolled past.
This site publishes several hundred pages about Ontario law. They are written carefully, they cite statutes and cases by name, and they are reviewed. None of that makes them advice about your matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is usually indefinite after a twenty year marriage is accurate as a general statement and may be wrong about you, because of a domestic contract you signed, a period of separation you have forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may not reflect an amendment made since, and a page about a subject currently before an appellate court may be overtaken between your reading it and your acting on it.
A conflict check must be completed. We act for a great many people and businesses, and we cannot act against a current client or use what we learned from a former one. That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are not doing, who is responsible for what, and how fees work. Until it is signed no relationship exists, whatever has been discussed.
Information sent through a form, or by email, before a retainer is signed is not covered by solicitor client privilege. That is not a policy we chose. It follows from there being no solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we are later approached by the other side, what you sent may affect whether we can act for either of you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it arose, and whether anything is urgent. That is enough for us to say whether we can help. The documents come after the retainer.
Case results described anywhere on this site are real and are described accurately, and they are specific to their own facts. A settlement at three times the original offer happened because of that employer, that contract and that person’s history. It says nothing about what your matter is worth.

Each page states the law as at the review date shown on it. Legislation is amended and case law develops. A page accurate when written may no longer be.

You are never obliged to accept a referral and are free to retain any firm you choose. No referral arrangement affects the independent professional judgment of any lawyer at this firm.
