A separation agreement is the most important legal document most people will ever sign. It determines how property is divided, how much support is paid and for how long, and how children are raised after a separation. Signed correctly with Independent Legal Advice, it is legally binding and enforceable in Ontario court.
In Brampton's community, a troubling pattern occurs: one spouse receives a separation agreement prepared by the other side's lawyer, often with subtle or significant unfairness built in, and signs it without getting their own Independent Legal Advice. Sometimes this happens under time pressure, sometimes under emotional pressure, sometimes because of a language barrier, and sometimes simply because the signing spouse does not know they are entitled to, and need, their own lawyer.
Ontario courts can set aside a separation agreement if a party lacked ILA, if there was financial non-disclosure, or if the agreement was unconscionable. But the better outcome is to get proper legal advice before signing, not to try to undo a bad agreement years later.

Does a separation agreement need to be witnessed or notarized in Ontario?
A separation agreement must be signed in the presence of a witness, but the witness does not need to be a lawyer or notary. It does not need to be notarized. What makes it enforceable is that both parties signed it freely, with full financial disclosure, and with Independent Legal Advice from their own separate lawyers.
Can I get an ILA review done quickly in Brampton?

My spouse prepared a separation agreement themselves without a lawyer. Is it valid?
A handwritten or self-prepared separation agreement can be valid in Ontario if it meets the requirements: both parties signed it freely, with full disclosure, and with Independent Legal Advice. However, self-prepared agreements are frequently challenged and often contain provisions that are legally unenforceable. We strongly recommend having any self-prepared agreement reviewed by a lawyer before treating it as binding.
What language will my ILA review be in?
We offer ILA reviews in English, Punjabi, and Hindi for Brampton clients. If you would prefer to have the agreement explained in Punjabi or Hindi, please mention this when booking. It is important that you genuinely understand every provision of the agreement before signing, that is the whole point of ILA.
Can a separation agreement deal with property we own in India or another country?
A separation agreement can address the allocation of overseas property, but enforcing those provisions in a foreign country depends on the laws of that country. We advise Brampton clients on Ontario's approach to overseas property in family law proceedings, and we recommend consulting local counsel in the relevant country for enforcement advice.
What happens if my spouse violates the separation agreement?
If your spouse breaches the terms of a registered separation agreement, you can bring an enforcement motion in Peel family court. For child or spousal support provisions, the Family Responsibility Office (FRO) can enforce registered support obligations. For property terms, a court application for specific performance or damages may be necessary.
