Spousal Support in Ontario, What You Need to Know
Spousal support (sometimes called alimony or partner support) is financial support paid by one spouse to another following separation. In Ontario, spousal support is governed by the Divorce Act (for married spouses) and the Family Law Act (for common-law partners of three or more years, or those with a child together).
Unlike child support, spousal support is not automatic. Entitlement must first be established, either on compensatory grounds (the supported spouse sacrificed career or education during the relationship), non-compensatory grounds (the supported spouse has financial need), or contractual grounds (the parties agreed to it). Once entitlement is established, the Spousal Support Advisory Guidelines (SSAG) provide ranges for the amount and duration.

Am I entitled to spousal support if we were common-law?
Yes, if you lived together continuously for at least three years, or if you have a child together and were in a relationship of some permanence. Common-law partners in Ontario have spousal support rights under the Family Law Act. The same SSAG guidelines apply.
How long does spousal support last?
Under the SSAG, support duration is tied to the length of the relationship. For shorter marriages, support tends to be time-limited. For longer marriages, typically ten or more years, indefinite support is common. "Indefinite" does not mean permanent; it means there is no fixed end date, and either party can return to court to vary or terminate.
Does adultery affect spousal support in Ontario?
No. Ontario is a no-fault province for support purposes. Adultery, abuse, and other conduct during the marriage are not relevant to spousal support entitlement or quantum. The analysis is based on economic factors, need, means, and the roles each spouse played during the relationship.
Can spousal support be paid as a lump sum instead of monthly?
Yes. Courts and agreements can provide for spousal support to be paid as a lump sum rather than periodic payments. A lump sum has advantages. It is final, it avoids ongoing enforcement issues, and it may have tax benefits depending on how it is structured. However, it also carries risks, if the recipient dies shortly after, the payor may have over-paid with no recourse.
What happens if my ex-spouse stops paying support?
If spousal support is set out in a court order or a registered agreement, the Family Responsibility Office (FRO) can enforce it, garnishing wages, seizing tax refunds, and suspending driver's licences. If it is only in an unregistered separation agreement, you would need to bring an enforcement motion in court.
Can I waive my right to spousal support?
You can waive spousal support in a separation agreement, but courts are cautious about such waivers, particularly in long marriages or where one party had significantly lower income. A court may set aside a spousal support waiver if enforcement would be unconscionable. Both parties need ILA when signing any agreement that includes a support waiver.
