Grounds for Contesting a Will in Ontario
A will may be challenged in Ontario on several grounds. The most common is lack of testamentary capacity, which requires that the testator understood the nature of the will, the extent of their property, the claims of persons who might expect to benefit, and the effect of the will's provisions. The leading test derives from Banks v. Goodfellow (1870) and has been consistently applied by Ontario courts.
Other grounds include undue influence, where a party exercised such domination over the testator as to override the testator's free will; lack of knowledge and approval, particularly where the testator did not understand or appreciate the contents of the will; fraud or forgery; and failure to comply with the formal execution requirements of s. 4 of the SLRA, which mandates the will be in writing, signed by the testator, and witnessed by two individuals.
SUSPICIOUS CIRCUMSTANCES
The Doctrine of Suspicious Circumstances
Under Ontario law, when suspicious circumstances are raised, the propounder of the will bears the burden of proving testamentary capacity and knowledge and approval on a balance of probabilities. The Supreme Court of Canada in Vout v. Hay [1995] 2 SCR 876 clarified that suspicious circumstances may relate to the capacity of the testator, whether the will reflects the testator's true intentions, or the circumstances surrounding the preparation and execution of the will.
Common suspicious circumstances include a significant change in testamentary dispositions shortly before death, the involvement of a primary beneficiary in the preparation of the will, a testator with declining cognitive health, or the exclusion of a natural object of the testator's bounty without explanation. PROCEDURE
Proving a Will in Solemn Form
When a will is contested, the court may require that it be proved in solemn form pursuant to s. 5 of the Estates Act. This is a full evidentiary hearing where the propounder must prove that the will was duly executed, that the testator had testamentary capacity at the time of execution, and that the testator knew and approved of the contents of the will. The proceeding is commenced by an application or, if necessary, converted to an action under Rule 75.06 of the Rules of Civil Procedure.
We prepare clients for every stage of this process, including the examination of the subscribing witnesses, the medical evidence regarding the testator's cognitive state, and the testimony of the solicitor who prepared the will. Where the solicitor followed the guidelines recommended by the Law Society of Ontario, including detailed attendance notes and capacity assessments, the will is more likely to withstand challenge. Where those safeguards are absent, the case for the challenger may be significantly strengthened.

Who can contest a will in Ontario?
Any person who has a financial interest in the estate may contest a will, including beneficiaries named in a prior will, intestate heirs, dependants of the deceased, and creditors of the estate. The applicant must demonstrate standing based on a legal or equitable interest.
What is testamentary capacity?
Testamentary capacity is the legal standard for the mental ability required to make a valid will. The testator must understand the nature of the act, the extent of their property, the persons who are the natural objects of their bounty, and how the will distributes their estate.
How do you prove undue influence in a will contest?
Undue influence requires proof that a party exerted such influence over the testator as to overpower the testator's free will, resulting in a will that reflects the wishes of the influencer rather than the testator. Unlike some other jurisdictions, Ontario does not presume undue influence in the testamentary context. The burden of proof rests with the party alleging it.
What happens if a will is found invalid?
If the most recent will is declared invalid, the court may give effect to a prior valid will. If no prior valid will exists, the estate is distributed according to the intestacy rules in Part II of the SLRA, which provide a statutory scheme of distribution among the deceased's spouse, children, and other relatives.
Can a will be partially invalidated?
Yes. In some circumstances, the court may sever an invalid portion of a will while upholding the remainder. This may occur where the undue influence or lack of capacity relates only to specific provisions rather than the entire instrument.
What is the role of the estate trustee during a will contest?
The estate trustee named in the contested will has a duty to propound the will and to remain neutral in the litigation. The estate trustee's reasonable legal costs in defending the validity of the will are generally payable from the estate.

Your rights, and how long we keep things
Your rights under PIPEDA
Under the Personal Information Protection and Electronic Documents Act,
S.C. 2000, c. 5 you may ask what personal information we hold about you, ask us to correct
anything inaccurate, and withdraw consent to our use of it, subject to legal and contractual
limits. We reply within thirty days or explain why we need longer.
Retention
Client files are kept for the period the law and the Law Society require, ordinarily
seven years after a matter closes, which reflects limitation periods and the
possibility of later proceedings. After that they are securely destroyed or anonymised. You may
ask for earlier deletion, subject to those obligations.
Enquiries that do not become files
If you contact us and no retainer follows, what you sent is retained only as long as our conflict
records require, then destroyed.
If you are not satisfied with our answer you may complain to the Office of the Privacy
Commissioner of Canada.

What this site is
Information, not advice
This site publishes several hundred pages about Ontario law. They are written carefully, they cite
statutes and cases by name, and they are reviewed. None of that makes them advice about your
matter. Law is applied to facts, and we do not know yours.
The difference is practical rather than technical. A page explaining that spousal support is
usually indefinite after a twenty year marriage is accurate as a general statement and may be
wrong about you, because of a domestic contract you signed, a period of separation you have
forgotten, or an income that is not what a tax return says it is.
Law also changes. Pages carry a review date where one is relevant. A page reviewed last year may
not reflect an amendment made since, and a page about a subject currently before an appellate
court may be overtaken between your reading it and your acting on it.
When we become your lawyers
Three things must happen first
A conflict check must be completed. We act for a great many people and
businesses, and we cannot act against a current client or use what we learned from a former one.
That check happens before anything else and occasionally means we have to decline.
We must confirm in writing that we are prepared to act. Not every matter is one we
can take, and saying so early is better than taking a file we cannot properly serve.
A retainer agreement must be signed. It sets out what we are doing, what we are
not doing, who is responsible for what, and how fees work. Until it is signed no relationship
exists, whatever has been discussed.
Confidentiality before a retainer
Why you should not send us documents yet
Information sent through a form, or by email, before a retainer is signed is not covered by
solicitor client privilege. That is not a policy we chose. It follows from there being no
solicitor client relationship for the privilege to attach to.
It can also create a problem for you. If you send us detailed information about a dispute and we
are later approached by the other side, what you sent may affect whether we can act for either of
you.
So tell us the shape of the problem and leave out the detail: the area of law, roughly when it
arose, and whether anything is urgent. That is enough for us to say whether we can help. The
documents come after the retainer.
Results, testimonials and reviews
What they do and do not tell you
Case results described anywhere on this site are real and are described accurately, and they are
specific to their own facts. A settlement at three times the original offer happened because of
that employer, that contract and that person’s history. It says nothing about what your
matter is worth.
Client reviews are the views of the people who wrote them. We do not offer anything in return for
a review, we do not write them, and we do not ask only the clients we expect to be positive.
Calculators on this site produce estimates from the figures you enter. They apply published
formulas and they cannot know about the facts that most often change the answer.
