Frequently Asked Questions

Is an online will legally valid in Ontario?

Yes. Your will is drafted from clauses approved by a licensed Ontario estates lawyer, reviewed by that lawyer before you see it, and signed following the requirements of the Succession Law Reform Act. Witnessing by video has been permanently legal in Ontario since 2021.

How does virtual signing work?

You join a video call with a Lexaltico lawyer, who acts as one of your two witnesses, and a second witness you provide. That second person cannot be anyone who inherits under your will. Everyone prints their own copy and signs it in ink on camera. Electronic signatures are not permitted for a will in Ontario, so it is always pen on paper.

How secure is my information?

Your answers are encrypted with AES-256 and stored on servers in Canada. Every time your file is opened it is logged, and only the lawyer working on it can read it.

What if I need changes after my will is drafted?

You ask for them through your secure portal. Your lawyer reviews the change and updates the document. Adjustments during the initial review are included in your fee.

Can my spouse and I do matching wills?

Yes, and we do that with a lawyer rather than online. When two people make wills together each of you is our client and each of you gives your own instructions, which is not something one person can do through a form on behalf of both. If you start online and tell us your spouse is making a matching will, we stop and arrange that instead. Nothing is charged.

What does it cost?

Fees agreed in writing before any work starts: Simple Will $599, Complete Estate Package $849, plus HST and disbursements such as courier. Your fee is held in our trust account and moves to the firm only as the work is done.

Is there anything you will not do online?

Yes, and we stop rather than carry on. If you and your spouse are making wills together, or you have a business, assets outside Ontario, a child from a previous relationship, or someone who inherits receives disability support, your will needs a lawyer to take instructions directly. Nothing is charged when that happens.
